Husband pays ₹55,000 maintenance dues in ₹1 and ₹2 coins, Jaipur court allows
Husband paid 11 months due amount in coins; The wife alleged 'mental harassment' over the incident.
In a bizarre incident, a Jaipur court allowed a man to pay his wife ₹55,000 in one and two rupee coins as maintenance which was due for 11 months after his family brought the money to the court in sacks.
Dashrath and Seema were married for 10 years. But after 3-4 years of marriage, massive disputes erupted between the two. As a result, Dashrath decided to file for divorce nearly a decade after their wedding. During the court proceedings, the family court ordered Dashrath to provide monthly maintenance of Rs 5,000 to Seema.
However, he did not pay it for 11 months. He was arrested on June 17 following the court’s recovery warrant against him for the non-payment of the maintenance amount.
“Since the husband refused to give the amount, the police arrested him. The family court was closed due to holidays so he was produced in the link court of Additional District Judge (ADG)-number 8. In the court, the family members of Dashrath reached with coins worth ₹55,000 to give to his wife,” said the advocate of the husband.
The advocate of his wife objected to this, but it was argued on behalf of the husband that these coins are legal tender and no one can refuse to accept them.
In the subsequent hearing scheduled for June 26, the court granted permission to the husband to present the maintenance amount in the form of coins. However, the coins will remain under the custody of the court until then. The husband will be required to count the coins and assemble them into packets of Rs 1000 each before delivering them to his wife in the presence of the court.
